EKGPhotos respects the privacy of visitors to this website: www.ekgphotos.com and is committed to making the best effort we can to safeguard your information. We will not wilfully disclose any personal information regarding our users without first obtaining their permission, unless required by law.
This policy will explain how we process, collect, manage and store details and how your rights under the GDPR and DPA are adhered to.
GDPR and the DPA
This website complies with the GDPR (General Data Protection Regulation) and DPA (Data Protection Act) May 2018.
We receive and reply to emails from users on a regular basis. The contact us form generates emails sent to: emma@ekgphotos.com. For record-keeping purposes we retain copies of all incoming and outgoing email. Information in the email we receive or send will not be disclosed to any third party without the permissions of the sender, either expressed or implied, unless required by law. If you wish to request for any email containing your personal information to be deleted, please email: emma@ekgphotos.com.
By completing the contact form you agree to EKGPhotos contacting you about our services, you will not be added to any mailing lists or passed onto any third parties.
Client Galleries
EKGPhotos creates a client gallery for each client to whom photos are delivered as part of the services contracted. The client galleries are externally hosted by www.wix.com.
To access a client gallery you will be required to enter personal data (email address) and a secure password. Your personal data (email address) will be stored within the Wix system. Their Privacy Policy can be found: https://www.wix.com/about/privacy.
If you wish to request for your personal data (email address) to be deleted from Wix servers, please email: emma@ekgphotos.com.
Retaining Client Data
EKGPhotos takes care over the processing of personal data stored on physical systems. EKGPhotos holds the following personal details of clients:

This data is only used to respond to your enquiry and the supply of services and is accessed through an office MacBook Pro which is password protected.
If EKGPhotos provides a service these details are held as both soft and hard copy contracts. Soft copy contracts are safely stored on an office MacBook Pro which is password protected and backed up to an encrypted external hard drive. Hard copy contracts are filed in an office safe.
Client photos are safely stored within a password protected office MacBook Pro and backed up to an encrypted hard drive.
Clients captured in photos
Under GDPR legislation, a photograph may in some instances constitute a form of personal data where they can be processed to allow “the unique identification of authentication of a natural person.” EKGPhotos will not photograph any individual as a means of unique identification or authentication unless contracted to do so by both parties. Guests appear in photos taken by EKGPhotos as a part of the recording of the event in photos. Guests captured in portraits or group photos do so as part of the event are their rights are protected by EKGPhotos as detailed in this privacy policy.
Clients and guests are photographed within the parameters of GDPR legislation on the basis of ‘legitimate interests.’ The taking of photographs of guests when viewed as a form of processing personal data is necessary for the legitimate interests of EKGPhotos as a photography business unless there is a good reason to protect a given individual’s personal data which overrides those legitimate interests.
We request our clients to direct their guests to read this privacy policy in advance of the event and to advise them to contact EKGPhotos in advance with any concerns around the processing of their personal data, namely being photographed.
Withdrawal of Consent
Any client or party guest photographed by EKGPhotos may withdraw consent for a photograph in which they appeared to be displayed.
Emails can be sent to: emma@ekgphotos.com specifying the photo to be removed. Action will be followed within 30 days of request.
Social Media Policy and Usage
While we have official profiles on social media platforms, users are advised to verify the authenticity of such profiles before engaging with, or sharing information on such profiles. We will never ask for personal details on social media platforms. Users are advised to conduct themselves appropriately when engaging with us on social media.
Display of Images
We may display any photographs to promote EKGPhotos on their website, on social media, advertising, display, website and internet promotion, competitions and public display providing that the images used are used lawfully and without damage to EKGPhotos clients.
The rights of the people captured in these photographs are protected by EKGPhotos as detailed in this privacy policy.
